COVID-19 PCR and Rapid Lateral Flow testing is used to determine the presence of the SARS-CoV-2 (COVID-19) virus including various strains/variants in a correctly, properly returned and intact swab sample, using the provided sample collection kit.

By purchasing our services, you are giving Red 1 Response Limited and it's partner laboratory service(s) your informed and freely given consent to perform the diagnostic tests you have ordered. Service may be facilitated by third party contractors or agents where authorised and permitted by Red 1 Response Limited and/or it's partner laboratories.

Services are offered subject to availability at the time of booking. Red 1 Response reserves the right to cancel, reschedule appointments or deliveries where it deems necessary, but Red 1 Response will endeavour to accommodate the client, where possible.

Limitation of liability

Red 1 Response can offer general guidance on the test you require for travelling, it is your responsibility to ensure you have the correct tests you need. It is your responsibility to refer to government advice and guidance relating to COVID-19 testing and the tests you should be completing. You will be liable for any expenses you should incur if you do not have the correct tests and your travel is disrupted.

Red 1 Response does not condone or encourage any breach of COVID-19 restrictions or regulations in the United Kingdom or abroad. You must consider the current legislated position in your area at the time of booking.

If due to COVID-19 restrictions, you are not able to travel to return your sample, then it is your obligation to make alternative arrangements for the sample to be returned to meet your timeframe.


Refunds can only be provided where a home test kit or HCP test has not yet been accepted, allocated or dispatched by Red 1 Response or it's partner laboratories.

Home test kits are not suitable for return due to health protection or hygiene reasons under Article 28(3)(a) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

It is a government requirement to meet United Kingdom Accreditation Service (UKAS) accreditation to ensure full chain of custody of samples is traceable. Each test kit is personalised with a unique reference number and further personalised with a unique booking reference number due to government requirements for passenger locator forms. The kit is therefore exempt from refunds as per Article 28(3)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Depending on the shelf life, test kits are liable to deterioration or rapid expiration and therefore are exempt from returns under Article 28(1)(c) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Fraud and criminal activity

Red 1 Response exercises a zero-tolerance approach to fraud, criminal activity, and breaches of COVID restrictions, in the interests of public health protection. Where Red 1 Response has reasonable belief or suspicion that the above described activity is underway, Red 1 Response reserves the right to engage local or national law enforcement and government bodies.


Provision/collection of the sample for you for testing by Red 1 Response and it's partner laboratories must be taken in accordance with the enclosed instructions and standard operating procedures. This includes both throat and nasal swab.

If, for any reason, you are unable to provide the sample as per the procedure detailed in the instructions provided we cannot guarantee that the sample provided will be suitable for analysis. Red 1 Response and it's partner laboratories accepts no responsibility for losses arising from such circumstances.

Force majeure

Red 1 Response cannot be held liability for any failure or delay to perform its obligations under this contract by an event of force majeure including but not limited to the following events:

  • Adverse events and severe weather (including but not limited to fires, explosions, floods, earthquakes, drought)
  • War (whether declared nor not), hostilities, conflict, invasion, act of foreign enemies, mobilisation, requisition or embargo
  • Rebellion, insurrection, civil war, coup d'etat, revolution
  • Radioactive contamination, fallout from any nuclear fuel or nuclear wastes
  • Riot, strikes, disorder unless solely restricted to employees of Red 1 Response or of it's subcontractors
  • Threats or acts of terrorism
  • Supply or delivery restrictions arising from governmental pandemic response
  • Limitations arising out of an Act or action of Government or with respect to any border travel, customs delay, trade restrictions
